Terms of Service

These Terms are the agreement between you and Foundry01, LLC, an Indiana limited liability company ("Foundry01," "we," "us"), covering Trace — the trytrace.net website, the Trace desktop app, and the Trace browser extension (together, the "Service"). By creating an account or using the Service, you agree to them.

The short version

  • Your guides are yours. We only use them to run Trace for you.
  • We never publish, showcase, or sell your content.
  • Our AI providers never train on your content, on any plan.
  • Neither do we. Trace has no model of its own to train, on any plan.
  • Trace captures whatever is on your screen. You are responsible for what you point it at, and for any consent the law requires.

1. Your account

You must be at least 18 years old. Give us accurate information, keep your password to yourself, and tell us promptly at admin@foundry01.com if someone gets into your account. Everything done under your account is your responsibility. You may not use Trace from a country, or as a party, subject to U.S. sanctions or export restrictions.

If you sign up on behalf of a company, you confirm you are allowed to bind that company to these Terms.

2. Plans and payment

Trace offers a free plan and paid plans (Pro, Teams, Enterprise). What each includes is on our pricing page. Paid plans bill in advance, monthly or yearly, and renew automatically until you cancel. Cancelling stops the next renewal; it does not refund the period you are in. We can change prices with 30 days notice. If a payment fails and stays unresolved, we may suspend your access.

3. Your content, and the licence you give us

You own everything you create in Trace — your workflows, screenshots, steps, guides, transcripts, and AI-generated text. We claim no ownership of any of it.

You grant us a worldwide, non-exclusive, royalty-free licence, sublicensable only to the hosting providers and subprocessors listed on our subprocessors page, to host, store, copy, process, display, and modify (for formatting and processing purposes only) your content, solely to operate and provide Trace to you and to the people you choose to share with, and only while your account is active. Delete your content and that licence ends with it.

We do not publish your content, feature it in marketing, put it in a public gallery or template library, or sell it.

If you send us feedback or suggestions about Trace, we may use them freely and without owing you anything.

4. Recording: what you are responsible for

Trace captures whatever is visible on your screen during a recording session. That can include a customer record open in another window, a colleague's name in a chat, or an account number in a spreadsheet. We do not automatically detect or redact this. Close what should not be captured before you start.

By recording with Trace, you confirm that:

  • You have every consent the law requires from anyone whose personal information, likeness, voice, or screen appears in a workflow.
  • You will not record a conversation you are not a party to. Recording laws vary by state and country, and some require consent from everyone present. In all-party-consent states, recording without that consent can be a criminal offence. Checking this is your responsibility, not ours.
  • You will not use Trace to record conversations about someone's health, or to capture health information about an identifiable person.
  • You will not use Trace to monitor or surveil anyone. Trace records only when you start a session, and stops when you stop it.

Student records. You may not use Trace to capture or process student education records covered by FERPA. Foundry01 does not act as a "school official," does not accept responsibility for student data, and does not sign FERPA addenda accepting that role.

Sensitive data generally. Trace is not built or certified for protected health information, payment card data, government identification numbers, or other highly sensitive records. Do not put them into Trace unless we have agreed otherwise in writing.

You will indemnify Foundry01 against any claim, loss, or expense arising from your content, your recordings, your breach of these Terms, or your breach of anyone else's rights.

5. Sharing links

Nothing you make is visible to anyone else until you share it, and Trace gives you two kinds of link. The difference matters:

  • A private link requires the person opening it to sign in, and it only works for people in your organization who already have access to that guide. There is no token in a private link, so there is nothing to revoke — access follows organization membership and permissions. Remove someone from the organization and the link stops working for them.
  • A public link carries a token, and anyone holding it can open the guide without signing in. It is unlisted, not secret: it can be forwarded, embedded on any website, or indexed by a search engine if someone posts it publicly. Embed codes use the same token.

Check your screenshots before you create a public link, because a public link is live from the moment it exists. You can shut one off by deleting the guide, an organization owner can switch public links off for the whole organization, and either takes effect immediately for every link already handed out. You can also ask us to disable a particular link at admin@foundry01.com. What none of that can do is recall copies someone already made, or pages a search engine already cached.

6. AI features and model training

Trace uses AI to transcribe your narration, read text out of screenshots, write step titles and descriptions, and power search. The providers we use are named on our subprocessors page.

Our AI providers do not train their models on your content. That applies on every plan, without exception, and we hold them to it through their service terms and account settings.

We do not train on your content either, on any plan. Foundry01 does not build or fine-tune models of its own, so your workflows, screenshots, guides, and transcripts are never used to develop or improve one.

On any plan, if you actively send us something as feedback — rating a search result, reporting a bad step title, sending us an example — we may use that to improve Trace.

AI output is assistive, not authoritative. Transcripts, captions, and step descriptions are generated automatically, can be wrong, and are yours to edit. Check anything that matters before you rely on it. Trace does not give legal, regulatory, medical, financial, or operational advice.

7. Acceptable use

You may not use Trace to:

  • break the law, or help anyone else break it
  • record or surveil people without the consent the law requires
  • access systems, accounts, or data you are not authorised to access
  • upload malware, or interfere with the Service or other people's use of it
  • harass, threaten, or impersonate anyone
  • copy, decompile, reverse engineer, resell, or sublicense the Service
  • use our name, logo, or branding without written permission

We may suspend or close an account that breaks these Terms, poses a security or legal risk, or is being used fraudulently.

8. Our intellectual property

The Trace software, interface, and branding belong to Foundry01. These Terms give you the right to use the Service on your plan — for business or personal purposes — and nothing more.

9. Ending your account, and your data

You can cancel or delete your account at any time from your account settings. Deletion runs after a 30-day grace period, during which you can cancel it. You can export your data at any point before then. After that your content is permanently deleted; see our Privacy Policy for the detail and the exceptions.

We may change, suspend, or discontinue the Service, in whole or in part, at any time, and we may suspend or close your account at any time for the reasons in section 7.

10. Warranties and liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. We do not promise a specific level of uptime.

To the maximum extent the law allows, Foundry01 is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or lost goodwill. Our total liability is capped at the fees you paid us in the 12 months before the claim, or $100 if you are on the free plan or using a beta feature. Some jurisdictions do not allow these limits, in which case they may not apply to you.

Beta and experimental features are provided as-is and may change or disappear without notice.

11. Business agreements take precedence

If your organization has signed a separate agreement or Data Processing Addendum with Foundry01, that document controls wherever it conflicts with these Terms.

12. Changes, law, and contact

We may update these Terms. For material changes we will email you or notify you in the Service before they take effect, and we will bump the version at the top of this page. Continuing to use Trace after that means you accept the update. If you do not, stop using the Service and close your account.

These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict-of-law rules. Disputes go to the state or federal courts in Indiana, and you and we both consent to that jurisdiction. If any provision is unenforceable, the rest stays in force. You may not assign these Terms without our consent; we may assign them to a successor.
